Welcome to Owners Agency (“we,” “us,” “our”). By accessing or using our website, services, or products, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our services. If you do not agree with these terms, please do not use our website.
1. Services Provided
We provide property-related services including, but not limited to:
Private-sale marketing packages for rentals and sales.
Vendor advisory services through our “DontSell” product.
Property management and finance lead generation.
Buyer representation in cooperation with licensed local agents.
Wealth creation and debt-reduction strategies.
All services are subject to the terms outlined here and any additional agreements entered into between you and us.
2. Eligibility
To use our services, you must:
Be at least 18 years old.
Have the legal capacity to enter into binding contracts.
Provide accurate and truthful information during sign-up and transactions.
We reserve the right to refuse service to any person or business that does not meet these requirements.
3. Property Listings
3.1 Vendor Responsibility – Vendors are responsible for providing accurate, lawful, and up-to-date property information, including images, descriptions, and any disclosures required by law.
3.2 Packages – We offer separate listing packages for sales and rentals. Prices, inclusions, and durations are displayed on our website and may change at any time without prior notice.
3.3 Approval – All listings are subject to our review and may be edited, suspended, or removed if they breach these Terms or applicable laws.
4. Payments & Fees
4.1 Upfront Payments – All packages, services, and advertising fees must be paid in full before a listing is published or services commence.
4.2 No Commission on Private Sales – For our private-sale packages, we do not charge a commission. However, if you upgrade to a full-service package, commission or agreed service fees will apply.
4.3 Price Changes – We may change prices at any time. Such changes will not affect services already purchased and confirmed.
5. No Guarantee of Sale or Rental
While we aim to provide high-quality marketing and exposure, we do not guarantee that your property will sell, rent, or achieve a specific price within a certain time frame. Market outcomes are influenced by many external factors beyond our control.
6. Conflict-Free Policy
We work exclusively in the vendor’s interest.
For full-service sales, we cooperate with buyer’s agents who represent the buyer only.
We do not act for both vendor and buyer in the same transaction to avoid conflicts of interest.
7. Intellectual Property
All content on our website, including text, images, videos, designs, and logos, is owned by us or licensed to us. You may not reproduce, distribute, or use this content for any purpose without our written permission.
8. Third-Party Services
Some services may involve third-party providers (e.g., payment gateways, buyer’s agents, marketing partners). We are not responsible for any loss or damage caused by these third parties, although we choose providers with care.
9. Limitation of Liability
To the fullest extent permitted by law:
We are not liable for any direct, indirect, incidental, or consequential loss arising from your use of our services.
Our total liability is limited to the amount you paid for the service in question.
10. Termination
We reserve the right to suspend or terminate your access to our services if:
You breach these Terms.
You engage in unlawful or fraudulent activity.
Your listing or conduct risks damage to our reputation.
11. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, store, and use your information.
12. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in Australia.
13. Changes to These Terms
We may update these Terms and Conditions at any time without prior notice. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
